Unfair-Labor-Practice Strikes:
The greatest degree of protection is extended to unfair-labor-practice strikes. An unfair-labor-practice strike is one caused or prolonged, in whole or in part, by unfair labor practices of the employer. Participants in such strikes are entitled to reinstatement in their jobs even though it may be necessary to discharge replacements to make room for them. Back pay also is customarily awarded from the time of an unconditional request for reinstatement (1 LRRM 703).
